Court Rules Joint Complaints Maintainable and FIR Publications Not Defamatory


In a notable judgment, the Himachal Pradesh High Court has quashed a defamation complaint against Surinder Sharma and another, concerning the publication of an FIR's contents in a newspaper. The judgment, delivered by Justice Rakesh Kainthla, emphasized that joint complaints are maintainable under Section 200 of the Criminal Procedure Code if they stem from the same cause of action. Furthermore, the Court clarified that publishing FIR contents does not constitute defamation under Section 500 of the Indian Penal Code, as such publications fall under the exceptions to Section 499 IPC.


The case arose when petitioners Surinder Sharma and Rajesh Kalia sought to quash a complaint filed by priests of the Mata Chintpurni Shrine, alleging defamation through a newspaper article. The article, based on an FIR, reportedly harmed the complainants' reputation. However, the Court found that the FIR publication was a legitimate function of the press, provided it was accurate and truthful, and thus protected under the law.


Additionally, the Court dismissed the argument that the absence of the newspaper editor as a party invalidated the complaint, stating that Surinder Sharma, the author, was the necessary party. The judgment also highlighted that complaints to the police are protected under legal exceptions, provided they are made in good faith.


This decision reaffirms the press's role in reporting facts in the public interest and clarifies legal ambiguities regarding the publication of FIR contents and the maintainability of joint complaints.

Joint complaints filed by two persons are maintainable under Section 200 of the Criminal Procedure Code if they arise from the same cause of action.
