Ex Officio Members Barred from Voting in Municipal Leadership Elections


In a significant ruling, the Himachal Pradesh High Court has fortified the principles of local self-governance by barring Ex officio Members, specifically Members of the Legislative Assembly (MLAs), from voting in the elections of President and Vice President of Municipalities within the state. The Division Bench of Justices Vivek Singh Thakur and Ranjan Sharma delivered the verdict, emphasizing the legislative intent to maintain the supremacy of elected members and preserve the autonomy of local governance bodies.


The judgment came in response to multiple petitions challenging the voting rights of Ex officio Members in municipal elections. The court meticulously examined the provisions of Article 243R of the Constitution, the Himachal Pradesh Municipal Corporation Act, 1994, and the Himachal Pradesh Municipal Election Rules, 2015. It concluded that the legislative framework clearly distinguishes between elected, Ex officio, and nominated members, granting the right to vote for municipal leadership only to elected members.


The court further clarified that the inclusion of Ex officio Members in the electoral process for municipal leadership positions would undermine the autonomy of local self-governance, contradicting the mandate intended by the people. The ruling also quashed a clarification issued by the Urban Development Department that was found to be contrary to the statutory provisions and the opinion of the State Election Commission, which holds the final say in interpreting election rules.


Legal experts have hailed the judgment as a reinforcement of the constitutional provisions aimed at empowering local governance bodies, ensuring that the mandate of the people is respected and preserved. The court's decision effectively stays any administrative orders permitting Ex officio Members to participate in these elections until a final resolution of the main petitions is achieved.

The Ex officio Members (Members of the Legislative Assembly) are not entitled to cast votes in the election of President and Vice President of Municipalities in Himachal Pradesh, as per the Himachal Pradesh Municipal Corporation Act, 1994 and Himachal Pradesh Municipal Election Rules, 2015.
