Himachal Pradesh High Court Upholds Benefits for National Award-Winning Teacher

Court finds discrimination in state's denial of service extension benefits to teacher awarded for NSS contributions.


In a significant judgment, the Himachal Pradesh High Court has upheld the decision of extending benefits to Daleep Kumar, a teacher and National Award recipient, who was previously denied service extension benefits by the state government. The court found the state's action discriminatory, as it had failed to extend the benefits prescribed under a notification dated September 24, 2015, which entitles teachers receiving national awards to two years of salary increment and those receiving state awards to a one-year service extension.


The case arose when Daleep Kumar, a recipient of the Indira Gandhi National Service Scheme (NSS) Award, was denied the benefits that should have followed his national recognition. The award, presented by the President of India in 2012, acknowledged Kumar's significant contributions to NSS activities, including expanding NSS units and promoting community service. Despite these achievements, the state argued that his award fell under a different scheme and was not covered by the government's notification.


The bench, comprising Chief Justice G.S. Sandhawalia and Justice Bipin Chander Negi, dismissed the state's appeal against a previous single judge's decision that had ruled in Kumar's favor. The court relied on Supreme Court judgments, including Union of India v. K.V. Jankiraman and State of Kerala v. E.K. Bhaskaran Pillai, which support the retrospective grant of benefits if an employee is unjustly kept away from them due to state action.


The court clarified that the notification in question broadly covers awardees, placing them at different levels based on the type of award received. Kumar, having been awarded for his NSS efforts, was deemed entitled to the benefits, as the notification supersedes earlier ones and does not exclude NSS awards.


The decision reaffirms the principle that state action should not unfairly withhold benefits from employees recognized for their contributions, irrespective of the scheme under which the award was granted. The court's judgment ensures that Kumar will receive emoluments for the two years following his retirement, adjusted against the pension already paid.


The ruling is expected to have wider implications for other teachers and employees in similar situations, potentially prompting a review of state policies regarding the recognition of national and state awards.
