In a significant ruling, the Himachal Pradesh High Court has upheld the state government's decision to establish a dedicated sub-cadre of teachers for CBSE-affiliated government schools. The court found the move to be constitutionally valid, transparent, and aimed at enhancing educational standards through a merit-based selection process.


The judgment came in response to petitions filed by the Joint Teachers Front of Himachal Pradesh and other individual teachers, challenging the creation of this sub-cadre and the requirement for in-service teachers to undergo a written test for selection. The petitioners argued that the sub-cadre created a class within a class, violating principles of equality under Articles 14 and 16 of the Constitution.


However, the court, led by Justices Vivek Singh Thakur and Ranjan Sharma, rejected these contentions. The bench noted that the state executive has the authority under Article 162 to formulate policies in the absence of specific legislation. The creation of the sub-cadre was deemed a reasonable classification with a clear nexus to the objective of ensuring quality education. The court emphasized that the policy was in line with the National Education Policy 2020 and aimed at improving teacher quality and educational outcomes.


The court also addressed concerns regarding the written test for teacher selection, ruling that it was a fair and transparent method to ensure merit-based recruitment. The judgment clarified that reservation policies applicable to direct recruitment and promotions do not extend to this selection process.


Furthermore, the phased implementation of CBSE-affiliated schools was justified by the court, considering the state's economic capacity. The court dismissed claims of discrimination, noting that the initiative was a strategic effort to upgrade government schools to national standards.


The ruling allows the state authorities to proceed with the implementation of the sub-cadre policy, including the declaration of results from the recent written screening test. The decision underscores the judiciary's role in balancing administrative reforms with constitutional mandates, ultimately supporting the state's vision of educational excellence.
