Himachal Pradesh High Court Upholds OBC Reservation in Teacher Recruitment

In a significant judgment, the Himachal Pradesh High Court has upheld the appointment of an OBC category candidate for the post of Punjabi Teacher in Government Senior Secondary School, Majari, District Bilaspur. The judgment was passed by Justice Ranjan Sharma, who dismissed the petition filed by Baljinder Kaur, who challenged the appointment of Daljeet Singh, an OBC candidate, claiming her non-selection was illegal.
The case revolved around the recruitment notice issued on August 6, 2010, which advertised six posts of Punjabi Teachers, including one reserved for the OBC category. Baljinder Kaur, the petitioner, argued that she was eligible for the reserved OBC post but was overlooked in favor of Daljeet Singh. However, the court noted that Kaur failed to apply for the position under the OBC category at the time of application, despite possessing an OBC certificate dated August 21, 2004.
The court emphasized the necessity of applying under the correct category to claim reservation benefits, highlighting that Kaur did not annex her OBC certificate with her application as required by the recruitment notice. Justice Sharma stated that merely belonging to the OBC category does not automatically confer the right to a reserved post if the candidate did not apply as such at the outset.
The court further noted that Kaur's OBC certificate had expired before the recruitment notice was issued, and there was no evidence she continued to qualify as an OBC candidate under the state's norms. Therefore, her failure to apply as an OBC candidate rendered her ineligible for the reserved post.
Additionally, the judgment clarified that recruitment rules take precedence over advertisement ambiguities, and qualifications mentioned in the rules are authoritative. The court found that Daljeet Singh met the eligibility criteria with his qualifications, including a 10+2 and Gyani Certificate, which were valid as per the recruitment rules.
The judgment also addressed the issue of delay and laches, as Kaur sought to challenge the recruitment process 15 years after its culmination. The court found this delay unacceptable, particularly in attempting to implead additional parties so long after the fact.
This ruling underscores the importance of adhering to recruitment procedures and timelines, especially concerning reservation benefits, and reinforces the principle that recruitment rules prevail in cases of conflict with advertisement details.
