Court Confirms Central Board of Higher Education, New Delhi as Non-Recognized; Termination Adheres to Natural Justice Principles
The Himachal Pradesh High Court has upheld the termination of Sandeep Kumar, a former Junior T/Mate at the Himachal Pradesh State Electricity Board Ltd., citing the invalidity of his matriculation certificate from the Central Board of Higher Education, New Delhi. The court, presided over by Justice Ajay Mohan Goel, confirmed the non-recognition of the board based on notifications from both the Directorate of Education, Government of National Capital Territory of Delhi, and the Himachal Pradesh Board of School Education.
Kumar, who secured his job in 2021, was dismissed following the discovery that his educational credentials were from a board not recognized by the competent authorities. The court detailed that the board had been listed as non-recognized since 1999, and the termination process adhered to the principles of natural justice, with Kumar being issued a show cause notice and his response duly considered.
The court noted that the matriculation examination was a significant component in assessing Kumar's eligibility for the position, contributing substantially to his merit score. Despite his arguments that the board was recognized and the termination arbitrary, the court found the termination justified, referencing historical notifications and public notices discrediting the board.
In its judgment, the court highlighted that the petitioner could not convincingly dispute the non-recognition of his board, and the employment secured on such a basis could not be sustained. The court also dismissed claims of procedural unfairness, affirming that due process was followed.
This ruling reinforces the importance of legitimate educational qualifications in public employment and the necessity for candidates to ensure their credentials are from recognized institutions.
Bottom Line:
Termination of services of an employee on the basis of matriculation certificate from a non-recognized Board upheld. Notification by competent authorities highlighting non-recognition of such Boards was considered valid and applicable.
