The detention was purportedly based on a dossier prepared by the Senior Superintendent of Police, Pulwama, which accused Bhat of being a potential operative working for active terrorists and influencing youth towards terrorism.


However, the court, presided over by Justice Rahul Bharti, noted several inconsistencies and errors in the detention records. The court highlighted discrepancies in the dates mentioned in the dossier and the grounds of detention, which reflected a lack of due diligence on the part of the authorities. Moreover, the court observed that the authorities had not applied their minds properly while issuing the detention order, as evidenced by contradictory statements and errors in the records.


The court emphasized the constitutional sensitivity required in exercising jurisdiction under the Public Safety Act and stressed the importance of strict adherence to procedural safeguards. It found that the authorities’ failure to address glaring errors and inconsistencies in the detention process rendered the detention illegal.


The court ordered the immediate release of Mudasir Ahmad Bhat from custody, restoring his personal liberty. This judgment underscores the judiciary's role in safeguarding individual rights and ensuring that preventive detention powers are exercised with utmost caution and responsibility.
