Jammu Development Authority Penalized for Auctioning Encroached Land

Court Orders JDA to Compensate Petitioner and Imposes Costs for Misleading Conduct


In a landmark judgment, the Jammu and Kashmir High Court delivered a stern rebuke to the Jammu Development Authority (JDA) for its mishandling of a land auction that took place in 2011. The court has directed JDA to refund the earnest money to the petitioner, Changa Ram, and provide an equivalent plot of land free from encumbrances. Additionally, the court has imposed costs on the JDA for misleading the court and causing unwarranted delays in resolving the petitioner's grievances.


The controversy erupted when Changa Ram was declared the highest bidder in an auction for a plot of land measuring 5.38 kanals at Chinor Chowk, Bantalab, Jammu. Despite depositing a substantial amount towards the purchase, the petitioner discovered that the land was encumbered with encroachments, including pucca structures, which had existed since before the auction notice was issued.


The court found that the JDA had acted arbitrarily by auctioning land it did not have possession of and retaining the petitioner's money for over 15 years without resolving the encumbrance issues. It was noted that the JDA failed to inform prospective bidders about the encroachments, thereby misleading them into participating in the auction under false pretenses.


The judgment emphasized the duty of public authorities to act fairly and transparently, especially when dealing with public land. It criticized the JDA for attempting to shift the consequences of its lapses onto the petitioner and for taking contradictory stands throughout the proceedings.


In a strong message against administrative arbitrariness, the court ordered the JDA to calculate the sale consideration for the encumbered and unencumbered portions of the land based on rates applicable at the time of the auction. The petitioner is to be compensated with an equivalent plot for the encroached portion and the balance amount adjusted accordingly.


The court further imposed costs of Rs. 50,000 on JDA, to be deposited in the Advocates' Welfare Fund, for misleading the court and for the undue delay in addressing the petitioner's grievances. The judgment underscores the importance of accountability and fairness in public administration, warning against the misuse of authority and highlighting the rights of citizens in property-related matters.
