Court Rejects Bail for Farooq Ahmad Dar, Citing Serious Allegations and Societal Impact  


In a significant judgment, the Jammu and Kashmir High Court, led by Justice M.A. Chowdhary, dismissed the bail application of Farooq Ahmad Dar, accused of repeated sexual assault and criminal intimidation. The case, originating from an FIR registered under Sections 376 and 506 of the Indian Penal Code at the Women Wing Kupwara Police Station, alleged that Dar had committed the offenses over a prolonged period. Despite the defense's argument of false implication due to family disputes and the absence of criminal antecedents, the court emphasized the gravity of the allegations and the strong prima facie evidence presented by the prosecution.  


The prosecution underscored the victim's corroborative statements and medical evidence, which supported the charges against Dar. The court, while acknowledging the legal principle that "bail is the rule and jail is the exception," stressed the need for greater caution in cases involving serious offenses against women. It pointed out that the societal ramifications of such crimes necessitate a careful balancing of the accused's liberty against the rights of the victim and societal interest.  


Additionally, the court rejected the contention that a compromise between the parties could justify a lenient view, highlighting the non-compoundable nature of the offense. The judgment also addressed a related criminal revision petition, affirming the trial court's decision to deny the summoning of additional defense witnesses, as such a move was deemed unnecessary for a just adjudication of the case. This comprehensive judgment reinforces the judiciary's commitment to addressing serious crimes against women with due diligence and societal consideration.
