Court rules Sub-Registrar cannot suspend registration proceedings awaiting clarifications from higher authorities


In a significant ruling, the Jammu and Kashmir High Court has directed the Sub-Registrar of Hiranagar to expedite the registration process of a sale deed without unnecessary delays. The judgment, delivered by Justice Rahul Bharti, emphasizes the administrative nature of the Sub-Registrar's role under the Registration Act, 1908, and clarifies that the Sub-Registrar does not possess quasi-judicial authority to suspend registration proceedings while awaiting instructions from superior authorities.


The case, titled "Angrez Singh v. Inspector General Registration," revolved around a writ petition filed by Angrez Singh through his attorney Ashok Kumar. The petition challenged the Sub-Registrar's decision to hold the registration of a sale deed dated November 25, 2025, pending clarifications from the Inspector General of Registration, Jammu. The sale deed pertained to land owned under specific government orders that required prior permission for alienation.


Justice Bharti's order underscores that the Sub-Registrar must either register or refuse the document as per Sections 17 and 18 of the Registration Act, 1908. The court held that the Sub-Registrar's actions in suspending the registration were beyond his jurisdiction and contrary to the precedent set by the Supreme Court in Satya Pal Anand v. State of M.P., which delineates the purely administrative function of the Registering Officer.


The court's decision mandates that the Sub-Registrar, Hiranagar, must decide on the registration of the sale deed within four weeks, urging compliance with the statutory provisions without succumbing to external administrative instructions. The judgment serves as a reminder of the statutory framework governing document registration and aims to prevent procedural delays caused by unwarranted administrative discretion.


The court also directed that a copy of the order be circulated among all Sub-Registrars and Registrars in Jammu and Kashmir to ensure uniform compliance and prevent similar occurrences in the future.


Bottom line:-

Registration of sale deed - Sub-Registrar has no authority to suspend decision on the registration of a document presented before him. His role is administrative and not quasi-judicial; he cannot seek clarifications from superior authorities or delay the decision-making process.
