In a significant ruling, the Jammu and Kashmir High Court has granted bail to Bhopinder Singh, who has been in custody for over nine years in connection with a murder case. The petitioner, Bhopinder Singh, was charged under Sections 302/34 of the Ranbir Penal Code and Section 30 of the Indian Arms Act for allegedly committing murder in March 2017. Despite the seriousness of the charges, the court found that the prolonged incarceration and evident contradictions in the testimonies of key eyewitnesses warranted the granting of bail.


Justice Shahzad Azeem, presiding over the case, noted that Singh's continued detention without a conclusion to his trial violated his fundamental rights. The prosecution had listed 30 witnesses, out of which 18 had been examined. The court observed discrepancies in the testimonies of these eyewitnesses, particularly regarding the manner of the crime and the presence of the accused at the scene.


The court drew parallels with the Supreme Court's stance in the case of 'Javed Gulam Nabi Shaikh v. State of Maharashtra,' which emphasized that the right to a speedy trial must be upheld regardless of the crime's severity. Singh's counsel, Mr. A. P. Singh, argued that the contradictions in testimonies rendered the prosecution's case doubtful, further supporting the plea for bail.


Despite the prosecution's argument regarding the heinous nature of the crime, the court ruled in favor of bail, citing the substantial delay in proceedings and the need to uphold constitutional rights. The conditions for bail include furnishing a surety bond, regular appearance in court, and refraining from influencing witnesses or tampering with evidence.


This ruling serves as a reminder of the judiciary's role in balancing the scales of justice, ensuring that fundamental rights are not overshadowed by procedural delays.
