In a significant legal development, the Jammu and Kashmir High Court has cancelled the bail granted to Parvaiz Ahmed Ganie, an accused in a rape case, originally sanctioned by the Additional Sessions Judge, Bandipora. The High Court's decision, delivered by Justice Sanjay Dhar, underscores the criticality of considering societal impact and relevant evidence in granting bail, especially in cases involving heinous crimes against women.
The case stems from an incident reported on December 27, 2022, where the prosecutrix accused Ganie of following her to her farmland, assaulting, and committing rape. Despite the seriousness of the charges under Sections 376, 341, and 506 of the Indian Penal Code (IPC), the trial court had granted bail, citing reasons like non-detection of spermatozoa on the victim's clothing and non-seizure of items allegedly used in the crime.
The High Court, however, found the trial court's reasoning flawed and the order perverse. It emphasized that meticulous analysis of evidence is not permissible at the bail stage, especially when only two out of twelve witnesses had been examined. The High Court criticized the trial court for not considering the societal implications of granting bail in such serious cases, which could undermine women's safety.
Justice Dhar highlighted that the absence of certain physical evidence, like the lighter and muffler allegedly used by the accused, should not undermine the prosecutrix's testimony if it is otherwise credible. He also noted that the delay in the trial was not significant enough to warrant bail, given the gravity of the charges.
The High Court's decision reflects a stringent stance on bail in cases involving serious offences against women, stressing that societal impact and the severity of the crime must be thoroughly assessed. The accused has been directed to surrender within a month, with the trial court tasked to expedite the examination of the remaining witnesses.
