Court Directs State to Provide Alternate Allotment Without Financial Burden to Kashmiri Migrant Entrepreneur
In a significant judgment, the Jammu and Kashmir High Court has directed the State and its instrumentalities to uphold the property rights of Kashmiri migrant entrepreneurs by ensuring fair treatment and protection without imposing undue burdens. The case involved M/s Sports Goods Industry, owned by Sh. K. L. Ambardar, who was affected by the mass migration of Kashmiri Pandits in 1989, resulting in the abandonment of his industrial unit.
Justice Rahul Bharti, presiding over the case, emphasized the obligation of the State to protect the properties of Kashmiri migrants. The court found that the State had failed in its duty by re-allocating the industrial shed initially allotted to the petitioner, without following due process. The court directed the State to provide two sheds or equivalent properties to the petitioner without charging any premium or arrears, thus ensuring equitable treatment.
