Jharkhand High Court Acquits Accused in Notorious Multiple Murder Case

Acquittal Granted Due to Eyewitness Testimony Inconsistencies and Suppression of Initial Police Report

In a landmark judgment, the Jharkhand High Court has acquitted Sanjay Yadav and others accused in a gruesome multiple murder case due to significant inconsistencies in eyewitness testimonies and the suppression of an initial report by the prosecution. The case, initially resulting in death sentences, revolved around the murders of four individuals in Dumri village on September 25, 2004.

The court, presided over by Judges Rongon Mukhopadhyay and Deepak Roshan, highlighted the lack of reliability in the identification of the accused as well as contradictions in the witness accounts. The prosecution's failure to produce the initial police report filed on the night of the incident further undermined their case, as emphasized in the case reference to "Allarakha Habib Memon v. State of Gujarat."

The court found that the testimonies of key witnesses were marred by inconsistencies and exaggerations, particularly regarding their ability to identify the accused on a moonlit night from significant distances. Additionally, the witnesses' accounts of the sequence of events were deemed unreliable, leading to the court granting the accused the benefit of doubt.

The judgment sets aside the previous conviction and death sentences handed down by the Additional Sessions Judge-IV, Koderma, and orders the immediate release of the accused unless they are wanted in other cases. The decision underscores the critical importance of credible evidence and procedural integrity in the pursuit of justice.

Bottom Line:

Acquittal of accused in a case involving multiple murders due to inconsistencies, contradictions, and lack of reliable evidence in witness testimonies, along with suppression of initial written report by the prosecution.
