Court Orders Jharkhand State Bar Council to Issue Certificate with Retrospective Effect Despite Petitioner's Subsequent Engagement with High Court


In a significant ruling, the Jharkhand High Court has directed the Jharkhand State Bar Council to issue an Enrolment Certificate to petitioner Richa Priya, a law graduate, whose application faced undue delay due to her subsequent engagement as a Law Researcher with the High Court. The Court, presided over by Justice Ananda Sen, clarified that Priya is entitled to the certificate with retrospective effect from October 15, 2024, although her license will remain suspended during her tenure with the High Court.


The petitioner, a B.A. LL.B. (Hons.) graduate from Amity University, applied for enrolment with the Bar Council on August 30, 2024. Despite the application being processed and cleared before her engagement with the High Court, Priya was excluded from receiving her certificate, a decision that led to this legal challenge.


Justice Sen highlighted the Bar Council's delay in processing applications and emphasized the necessity of timely meetings by the Enrolment and Scrutiny Committees. The Court mandated that the Bar Council must conduct these meetings at least twice a month to prevent future delays.


The ruling comes after Priya filed a writ petition, representing herself, and argued the case against the Bar Council's decision. She cited mental distress and professional hindrances due to the withholding of her enrolment certificate and educational documents.


In response, the Court acknowledged Priya's rightful claim to the certificate, stating that her application was complete and cleared before her engagement, thus entitling her to enrolment. The ruling serves as a reminder of the procedural responsibilities of bar councils and provides relief to Priya, allowing her to continue her professional journey without further hindrance.


Bottom line:-

A petitioner, despite being later engaged as a Law Researcher/Research Associate in the High Court, is entitled to an Enrolment Certificate from the State Bar Council if the eligibility and scrutiny process were completed before the engagement.
