Court Orders a Pause on Coercive Actions, Citing Concerns Over Investigation Procedures and Media Influence


Ranchi, February 19, 2026 - In a significant development, the Jharkhand High Court has ordered a stay on the investigation and any coercive actions in connection with two interlinked cases arising from a road accident involving petitioner Manoj Tandon. This decision comes amidst allegations of biased investigation and undue media influence, which the court deemed alarming and potentially harmful to the pursuit of justice.


Presided over by Justice Sanjay Kumar Dwivedi, the case was brought to the court's attention due to the urgency highlighted by the petitioner's counsel. The petitioner, a practicing advocate, was involved in a minor road accident on February 17, 2026, which led to two separate police cases being lodged at Doranda Police Station. Notably, the cases were being investigated by different officers, raising concerns about impartiality and procedural fairness.


The court emphasized the necessity for investigations arising from the same incident to be handled by a single investigating officer, as mandated by Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023. This provision ensures that procedural safeguards, such as issuing notices, are adhered to, thereby preventing undue harassment and maintaining fairness.


During the proceedings, the court was informed of an alleged media trial orchestrated by the investigating officer in one of the cases. The petitioner’s counsel argued that this media involvement, coupled with the handling of the investigation by officers from specific communities, could lead to a miscarriage of justice. Furthermore, the lack of proper seizure protocols and the involvement of a banned organization were highlighted as areas of concern.


Acknowledging the gravity of the situation, the High Court underscored its constitutional duty to protect federal principles and ensure justice. Consequently, the court stayed the proceedings and coercive actions in both Doranda P.S. Case No. 51 of 2026 and Doranda P.S. Case No. 52 of 2026, pending further investigation and adherence to legal protocols.


The Senior Superintendent of Police in Ranchi has been tasked with overseeing the situation to ensure no harm befalls the petitioner. The court has scheduled the next hearing for March 24, 2026, allowing time for the relevant authorities, including the Central Bureau of Investigation and the Union of India, to provide their inputs.


This judgment reaffirms the judiciary's role in safeguarding individual rights against potential procedural violations and media bias, setting a precedent for handling similar cases in the future.
