In a significant ruling, the Jharkhand High Court upheld the acquittal of three individuals accused of dowry-related cruelty and attempted rape. The court's decision came in response to an appeal filed by the victim, challenging the judgment of the Principal Sessions Judge, Jamtara, which had acquitted the accused due to insufficient evidence.


The case revolves around allegations made by the victim, who was married to Md. Taleb Ansari in 2017. She accused her husband, father-in-law Rajauddin Ansari, and brother-in-law Sultan Ansari of demanding an additional dowry of ?1,00,000 and subjecting her to cruelty. Furthermore, she alleged that her father-in-law and brother-in-law attempted to rape her.


The trial court found the evidence presented by the prosecution to be lacking in cogency and reliability, leading to the acquittal of the accused. The victim, dissatisfied with this verdict, appealed to the Jharkhand High Court.


During the appeal proceedings, the victim's counsel argued that key witnesses, including the victim's family members, supported her claims without any major contradictions. However, the High Court, comprising Justices Rongon Mukhopadhyay and Pradeep Kumar Srivastava, noted that the prosecution's case was weakened by the delay in filing the FIR and the absence of specific evidence. The court emphasized the need for careful scrutiny of testimonies from interested witnesses, such as family members, and found the hearsay evidence insufficient to substantiate the allegations.


In its judgment, the High Court concurred with the trial court's findings, highlighting that the prosecution failed to establish the charges convincingly. The court observed that the possibility of false implication could not be ruled out, especially given the strained relationship between the victim and her husband and the lack of credible evidence supporting the allegations.


Consequently, the High Court dismissed the appeal, affirming the acquittal of the accused and upholding the trial court's decision. The ruling underscores the importance of robust and credible evidence in criminal cases, particularly those involving serious allegations like dowry harassment and attempted rape.
