Court Refuses to Impose Exemplary Costs in Abuse of Law Case, Dismisses Petition Seeking Quashing of Cases and Registration of Crime


In a recent judgment, the Karnataka High Court, presided over by Justice M. Nagaprasanna, dismissed a petition filed by Kallalinga E Hoogar, a dismissed employee of the Karnataka Power Transmission Corporation Limited. The petitioner sought to quash cases and register criminal investigations against several officials and elected representatives, including the Chief Minister, Deputy Chief Minister, and other members of the Legislative Assembly, on grounds of alleged corruption and misuse of power. The court identified the petition as an abuse of the process of law and dismissed it accordingly.


The petitioner, who represented himself in the court, aimed to implicate 51 individuals, including high-ranking government officials and corporate entities, alleging that they were involved in various corrupt practices. The petitioner also sought the intervention of constitutional bodies such as the Central Bureau of Investigation (CBI), National Investigation Agency (NIA), Enforcement Directorate (ED), and Income Tax Department for immediate investigation into the alleged offenses.


Justice Nagaprasanna, in his oral order, highlighted that allowing such a petition would constitute an abuse of the judicial process. The court acknowledged the petitioner's status as a dismissed employee and refrained from imposing exemplary costs, which it noted could have amounted to Rs. 10,00,000/-, given the frivolous nature of the petition. The judgment emphasized the court's restraint in not imposing financial penalties despite recognizing the petition as a fit case for such an action.


The petitioner's dismissal is currently under challenge in another proceeding (W.P.No.22727/2021), and the court observed that the present petition was an attempt to misuse the judicial process by targeting numerous public officials without substantiated grounds. The court's decision underscores the judiciary's commitment to preventing the abuse of legal processes while balancing the interests of justice by not imposing heavy penalties on individuals who misuse the system.
