Court Orders Recovery of Salaries from Officers Effecting Transfers Without Assigning New Posts


In a landmark judgment delivered on January 30, 2026, the Karnataka High Court has issued significant directives aimed at addressing the inefficiencies and misuse of public funds arising from the practice of transferring government officers without assigning them new postings. The court's decision came in response to a writ petition filed by Sri. K Arun Kumar, who challenged his transfer without a subsequent posting, which left him in administrative limbo for nearly a year.


The Division Bench, comprising Justices S.G. Pandit and K.V. Aravind, emphasized the importance of ensuring that government officers are not left without work, highlighting the financial burden imposed on the state due to salaries being paid to officers who have no active assignments. The court noted that such practices lead to administrative inefficiency and misuse of taxpayers' money.


The petitioner, who served as the Deputy Commissioner of Excise in Belagavi North District, was displaced from his position in January 2025 without being assigned a new post. Despite reporting to the competent authority in February 2025, he remained without an assignment, prompting him to approach the Karnataka State Administrative Tribunal, which dismissed his plea. Dissatisfied, he escalated the matter to the High Court.


During the proceedings, the court directed the state to provide a posting to the petitioner, resulting in his appointment as Deputy Commissioner of Excise at the Head Office in Bengaluru by mid-January 2026. The court further ordered the Principal Secretary, Finance Department, to file an affidavit explaining the delay in assigning posts to officers, revealing systemic inefficiencies.


In its order, the High Court outlined several key directives to prevent future occurrences. It mandated that officers should not be relieved from their current duties without a new posting and warned that salaries paid to officers in such situations would be recovered from the responsible officials. The judgment also called for the circulation of the court's order among all departmental heads to ensure compliance.


The case also referenced a similar judgment in Miss. Seema v. State Of Karnataka Department Of Forest, Environment And Ecology, where the practice of lifting officers without providing postings was criticized.


This decision underscores the judiciary's commitment to enhancing administrative efficiency and safeguarding public resources, setting a precedent for the handling of government transfers in Karnataka.
