Karnataka High Court Modifies Sentence for Rash and Negligent Driving Case

Court Recognizes Mitigating Circumstances, Reduces Imprisonment to Court Rising, Enhances Compensation to Rs. 1 Lakh


In a recent judgment, the Karnataka High Court has modified the sentence of Mr. Riyaz Ahmed, who was convicted for rash and negligent driving resulting in the death of Anand Shetty. The court acknowledged the mitigating circumstances, including Mr. Ahmed's actions in assisting the injured victim immediately after the accident and his willingness to pay compensation to the victim's family. The court reduced the original sentence from one year of simple imprisonment to imprisonment till the rising of the court and increased the fine to Rs. 1,00,000, to be paid as compensation to the deceased's dependants.


The case stemmed from an incident on July 15, 2015, where Mr. Ahmed's driving led to a fatal accident. Despite witnesses turning hostile, the court maintained the conviction based on sufficient evidence. Mr. Ahmed, represented by advocate Sri Harinath M.S, demonstrated his readiness to enhance the compensation, leading the court to reconsider the severity of his sentence. The High Court considered his conduct post-accident and his current financial and health conditions, which included losing his job and having a rod implant in his leg.


The court ordered the enhanced fine to be paid in two installments, recognizing Mr. Ahmed's financial constraints. The compensation of Rs. 50,000 each will be awarded to the deceased's wife, Mrs. Sumathi, and son, Sri Santhosh Kumar. The judgment also stipulated that failure to pay the enhanced fine would revert the sentence to the original order by the trial magistrate.


Justice V. Srishananda presided over the case, emphasizing the importance of recognizing mitigating factors while ensuring justice for the victim's family. The decision reflects a balanced approach, considering both the circumstances of the accused and the needs of the deceased's dependants.
