Tribunal's Decisions on Unpaid Dues and Security Deposit Maintained, Claims for Stones and Expenses Overturned

Poonacha, upheld parts of the arbitral award favoring Sridhar while overturning others.
The dispute originated from a contract for developing a residential layout in Hootagalli Industrial Area, Mysuru. The agreement, signed in 2013, tasked Sridhar with completing specific unfinished works for a total of ?4.71 crore. The conflict arose when Sridhar claimed unpaid dues and additional costs, leading to arbitration proceedings.
The Tribunal had ruled in favor of Sridhar, granting him Rs. 79.58 lakh, including unpaid dues and interest. However, M/s Automotive Axles contested this decision, leading to an appeal in the High Court. The Court's judgment partially upheld the Tribunal's findings, affirming the decision regarding unpaid dues and security deposit refund while setting aside awards for stone costs, watch and ward expenses, and interest on a Fixed Deposit (FD) due to insufficient evidence.
