Court Directs NWKRTC to Establish Transfer Guidelines for Class-IV Employees to Ensure Fairness and Transparency


In a significant ruling, the Karnataka High Court has set aside the transfer order of a Class-IV employee of the North West Karnataka Road Transport Corporation (NWKRTC), citing a lack of transparency and arbitrariness in the decision-making process. The court has also directed the corporation to establish transfer guidelines within three months to prevent future instances of unfair administrative decisions.


The judgment, delivered by Justice Smt. Lalitha Kanneganti, addressed the writ petition filed by Shri. Chandrakanth Y. Toravi, who challenged his transfer from the Chikodi Division to the Belagavi/Khanapur Division. The petitioner, a Driver-cum-Conductor, argued that the transfer was issued without any request or justification, unlike the 43 other employees who were transferred upon request.


In her ruling, Justice Kanneganti emphasized the necessity of adhering to clear and uniform standards when transferring employees to ensure fairness and transparency. The court found that the NWKRTC's lack of transfer guidelines led to arbitrary decisions, which could undermine employee confidence and organizational integrity.


Despite the NWKRTC's claims that the transfer was made on administrative grounds, the court noted that the order did not provide specific reasons or exigencies, thus failing to justify the decision. The court highlighted that while the corporation has the authority to transfer employees, such actions must be guided by well-defined norms to prevent arbitrariness.


The court's order mandates the NWKRTC to formulate comprehensive transfer guidelines applicable even to Class-IV employees within three months. Until these guidelines are established, any transfer made on administrative grounds must be accompanied by a detailed explanation.


This ruling underscores the judiciary's role in ensuring accountability and fairness within public administration, reinforcing the principle that administrative decisions must be transparent and justifiable.
