Advocate Pradeep Kumar cleared of charges; court emphasizes protection of advocates from misuse of criminal law.


In a significant judgment, the Karnataka High Court has quashed criminal proceedings against Advocate Pradeep Kumar, who was accused of forgery and other charges under the Bharatiya Nyaya Sanhita, 2023. The case, registered as Crime No.94/2024, involved allegations that Kumar, while representing clients in a matrimonial dispute and related proceedings, engaged in unlawful activities. The High Court, presided over by Justice M. Nagaprasanna, concluded that the accusations lacked essential ingredients to constitute the offences charged, and that the advocate's actions were confined to his professional duties.


The case arose when Pradeep Kumar represented accused Nos.2 and 3 in a dispute involving allegations of dowry harassment and caste-based abuse. The court found that Kumar's role was limited to filing legal documents and seeking information under the Right to Information Act, actions that are part of an advocate's professional obligations.


The High Court was critical of the complainant, an Assistant Conservator of Forests, who initiated the complaint against Kumar. The judgment highlighted that invoking criminal proceedings against advocates solely for their professional activities undermines the independence of the bar and the justice system's sanctity. Justice Nagaprasanna emphasized that such practices could deter advocates from performing their duties fearlessly, thus impacting the administration of justice.


The court also admonished public servants for misusing coercive powers to intimidate advocates, warning against future repetition of such conduct. The judgment serves as a reminder of the importance of protecting legal professionals from unwarranted legal harassment, thereby ensuring the integrity and independence of the legal profession.


Bottom line:-

Advocates representing clients within their professional capacity cannot be subjected to criminal prosecution solely for discharging their professional obligations, and such actions against advocates strike at the independence of the bar and administration of justice.
