The case stemmed from an incident on July 10, 2019, where Mr. Sudhakar, a Member of the Legislative Assembly, was allegedly obstructed and assaulted while attempting to submit his resignation. Despite these allegations, the court found no evidence of physical hurt as no medical or wound certificates were presented, nor were there any witness testimonies substantiating the claim of assault leading to injury.
The counsel for the petitioner argued that the continuation of the proceedings amounted to an abuse of process, citing the lack of prima facie evidence against Mr. Ahmed. The charge sheet, filed on November 23, 2020, also failed to provide sufficient material to support the claim of hurt being caused.
Justice Yadav emphasized that the ingredients of Section 323 IPC require concrete evidence of an act intended to cause hurt, which was not demonstrated in this case. Therefore, the proceedings related to this charge were set aside.
However, the petitioner reserved the right to address charges under Section 341 IPC at the trial court, with the liberty to take an appropriate stand during the hearing before charge. The court's decision has left the door open for further legal proceedings concerning the alleged offense under Section 341 IPC.
