In a landmark judgment, the Karnataka High Court has upheld the conviction and life sentences of the accused in the sensational murder case of Hareesha, a resident of Thirthahalli. The Division Bench, comprising Justices H.P. Sandesh and Venkatesh Naik T., dismissed the appeals filed by the convicted individuals, affirming the trial court's decision.


The case dates back to October 3, 2017, when Hareesha was brutally murdered outside his home in Thirthahalli, allegedly due to a land dispute. The prosecution presented a robust case, highlighting a conspiracy orchestrated by the fourth accused, who reportedly paid a substantial sum to the primary assailants to execute the crime. The motive was established through eyewitness accounts and corroborated by circumstantial evidence, including the recovery of blood-stained clothing and weapons linked to the accused.


The High Court meticulously reviewed the evidence, which included eyewitness testimony from the victim's wife, identification of the accused in a Test Identification Parade, and forensic reports confirming the presence of the victim's blood on the weapons and clothing recovered from the accused. The defense's arguments, challenging the credibility of the eyewitness and the procedures followed during the Test Identification Parade, were rejected by the court. The judges noted that the evidence presented was consistent and compelling, leaving no doubt about the guilt of the accused.


In addition to the murder charges under Section 302 read with Section 120B of the Indian Penal Code, the court also upheld the conviction under Section 323 for causing simple injuries to the victim’s wife. The accused were sentenced to life imprisonment with a fine, with the court emphasizing the gravity of the crime and the need for stringent punishment.


The judgment reinforces the importance of thorough investigation and the role of circumstantial evidence in securing convictions in complex criminal cases.
