Court dismisses husband's writ petition, affirms Rs.20,000 monthly maintenance despite wife's employment.


In a significant decision, the Karnataka High Court upheld an order directing a former software engineer to pay Rs.20,000 per month as interim maintenance to his wife. The judgment, delivered by Justice Dr. K. Manmadha Rao, dismissed the husband's writ petition challenging the Family Court's decision, asserting that an able-bodied husband is presumed capable of earning and fulfilling his matrimonial obligations.


The case, titled "Mr. Prakash Murigeppa Harapanahalli v. Mrs. Shwetha Walvekar," revolved around the interim maintenance claim filed by Mrs. Walvekar, despite her earning Rs.40,000 per month as Administrative Support at a Bangalore-based firm. The Family Court had initially reduced her claim from Rs.70,000 to Rs.20,000, which Mr. Harapanahalli contested, citing his unemployment following an organizational restructuring.


The High Court, however, emphasized the substantial earning capacity of Mr. Harapanahalli, highlighted by his past lucrative income and Tax Deduction Statements, thereby dismissing his unemployment claim as a valid defense. The Court also recognized that a wife's gainful employment does not negate her right to maintenance if her income is insufficient to maintain a lifestyle similar to that during the marriage.


Justice Rao cited the Supreme Court's ruling in "Rajnesh v. Neha," reinforcing the presumption of earning capability for able-bodied husbands and underscoring the maintenance's role in preventing destitution. The judgment maintained the Family Court's order as just and reasonable, urging the husband to clear all arrears within three months.


This decision underscores the judiciary's stance on ensuring financial support for spouses, promoting equitable financial justice in matrimonial disputes.
