Court Orders Payment with 18% Interest, Dismisses Defendant's Counterclaim Due to Lack of Evidence


In a significant ruling, the Karnataka High Court has upheld the claims of M/s. Living Waterefine Technologies Pvt. Ltd. against M/s. MVJ College of Engineering Venkatesha Education Trust in a commercial dispute concerning the refurbishment and maintenance of a sewage treatment plant (STP). The court's decision mandates the defendant to compensate the plaintiff with a total amount of Rs. 8,26,880 for refurbishment services and Rs. 8,82,050 for operation and maintenance (O&M) services, both with an interest rate of 18% per annum from the respective due dates until the payment is made.


The judgment, delivered by a division bench comprising Chief Justice Vibhu Bakhru and Justice C.M. Poonacha, stems from an appeal filed by the defendant challenging the Commercial Court's decree, which favored the plaintiff. The court affirmed that the plaintiff had successfully proven the supply of materials and completion of refurbishment work, as well as the provision of O&M services, through substantial evidence including invoices and documented communications.


Central to the dispute was the plaintiff's claim that despite fulfilling contractual obligations, including the refurbishment of the STP and ongoing maintenance, the defendant failed to settle the outstanding amounts. The defendant, however, contended that the plaintiff did not complete the work as agreed, resulting in additional costs incurred from hiring an alternative service provider.


The High Court found the defendant's arguments unsubstantiated, noting the absence of evidence to support their counterclaim for rectification costs. The court underscored that the defendant failed to demonstrate the payment of expenses to another vendor, which led to the dismissal of their counterclaim.


In addition to upholding the principal claims, the court validated the imposition of an 18% interest rate, recognizing the nature of the transaction as commercial. The judgment reflects the court's acknowledgment of the plaintiff's adherence to contractual terms and the defendant's inability to provide credible evidence to the contrary.


The ruling serves as a reminder of the importance of maintaining thorough documentation and evidence in commercial transactions, particularly in disputes involving service contracts and claims for payment.
