Kerala High Court Clarifies Timing of Judgment Effect in Marriage Dissolution Case

Court rules on the validity of marriage contracted on the same day as the divorce decree of a previous marriage.


News Report: In a significant ruling, the Kerala High Court delivered a judgment that clarifies the timing of when a judgment dissolving a marriage takes effect, impacting the validity of subsequent marriages. The case, Rakhi v. Krishnakumar, revolved around the petitioner Rakhi, whose previous marriage was dissolved by a judgment on the same day she contracted a new marriage with Krishnakumar. The court was asked to decide whether the marriage contracted before the judgment's delivery time was valid.


The division bench, comprising Mr. Devan Ramachandran and M.B. Snehalatha JJ., underscored that a judgment dissolving a marriage takes effect from the commencement of the day it is delivered, not from the specific time of its delivery. This legal principle protects marriages contracted after the decree from challenges, except by the former spouse. The bench overturned the Family Court's decision, which had allowed amendments to pleadings that introduced conflicting substantive prayers without alternative reliefs, declaring them impermissible.


The court examined the provisions of Section 15 of the Hindu Marriage Act, 1955, which authorize remarriage only after the appeal period against the divorce decree has expired or if an appeal has been dismissed. In this case, the court confirmed that the petitioner’s marriage on the same day as the divorce decree was legally valid, as there was no appeal against the decree.


The bench further clarified the procedural aspects under the Civil Procedure Code, 1908, highlighting that judgments become effective as soon as pronounced and dated, with the limitation period starting from the date of judgment, not its time of delivery.


This judgment provides crucial clarity on how judgments should be interpreted concerning their effect and timing, thereby ensuring legal certainty in marital status changes.
