Kerala High Court Enhances Compensation for Accident Victim's Legal Heirs

Tribunal's Award Modified, Additional Rs. 2.66 Lakh Granted with 9% Interest


 In a significant ruling, the Kerala High Court has enhanced the compensation awarded to the legal heirs of a deceased accident victim. The case, Mariyakutty v. United India Insurance Company Ltd., revolved around the tragic demise of a young electrician cum plumber, who succumbed to injuries following a road accident in 2014. Dissatisfied with the initial compensation of Rs. 12.94 lakh awarded by the Motor Accidents Claims Tribunal, the claimants, comprising the mother and siblings of the deceased, sought an enhancement.


The High Court, presided over by Justice Shoba Annamma Eapen, recalculated the compensation by refixing the deceased's monthly income to Rs. 9,500, in line with the Supreme Court's precedent in Ramachandrappa v. Manager, Royal Sundaram Alliance Insurance Co. Ltd. This adjustment, coupled with a 40% addition for future prospects as per the guidelines in National Insurance Co. Ltd. v. Pranay Sethi, resulted in a recalculated compensation for loss of dependency at Rs. 14.36 lakh.


Furthermore, the Court addressed the allocation of compensation under various heads. The tribunal's awards for funeral expenses and loss of estate were adjusted to conform to established norms, and an additional Rs. 20,000 was allocated for pain and suffering. However, the Court reduced the compensation under the head of loss of love and affection, adhering to the Supreme Court's interpretation in Magma General Insurance Co. Ltd. v. Nanu Ram Alias Chuhru Ram, which subsumed this under loss of consortium.


The High Court ultimately awarded an additional Rs. 2.66 lakh to the claimants, bringing the total compensation to Rs. 15.60 lakh, with an annual interest rate of 9% from the date of the petition until realization. The insurance company has been directed to deposit the enhanced amount within two months.


This judgment underscores the judiciary's commitment to ensuring fair compensation for accident victims and their families, while also adhering to the legal precedents set by higher courts.
