Kerala High Court Enhances Compensation for Amputee in Landmark Ruling

Court Recognizes Lifelong Costs of Prosthetics and Rehabilitation in Accident Compensation Case


In a significant ruling, the Kerala High Court, presided over by Justice Mrs. M.B. Snehalatha, has substantially increased the compensation awarded to Ummer C.K., a victim of a motor vehicle accident that resulted in the amputation of his right leg above the knee. The court has set a precedent by acknowledging the necessity of considering future expenses for prosthetic limb replacements, maintenance, and rehabilitation in compensation awards.


The appellant, Ummer C.K., aged 24 at the time of the accident, was originally awarded Rs. 3,47,900 by the Motor Accidents Claims Tribunal for a prosthetic leg. However, the tribunal did not account for the periodic replacements and maintenance costs, which are essential for ensuring the claimant's dignity and functional mobility throughout his life.


Recognizing the inadequacy of the initial award, the Kerala High Court enhanced the total compensation for the prosthetic limb to Rs. 30,00,000. This amount includes Rs. 24,00,000 for eight prosthetic limbs, considering an assumed life expectancy of 70 years and a five-year replacement cycle, and Rs. 6,00,000 for maintenance expenses.


Furthermore, the court adjusted the notional income of the claimant, who was employed abroad, to Rs. 7,000 per month from the Rs. 4,500 per month initially considered by the tribunal. The total disability compensation was subsequently increased to Rs. 16,93,440, reflecting the claimant's future prospects.


The ruling emphasized the principle of "restitutio in integrum," which aims to restore the injured person to a position approximating the one prior to the accident. The court highlighted that compensation should not be merely symbolic but must effectively address the claimant’s needs, ensuring mobility, confidence, and dignity.


This decision aligns with previous Supreme Court judgments, including those in the cases of Mohd. Sabeer @ Shabir Hussain and Prahlad Sahai, which underscored the importance of realistic and humane compensation for accident victims requiring prosthetic limbs.


The insurance company, Oriental Insurance Company Ltd., has been directed to deposit the enhanced compensation amount within two months, failing which the amount will accrue interest at 8% per annum. The court also noted that due to a delay in filing the appeal, the claimant would not receive interest on the enhanced amount for the period of delay.


This landmark judgment sets a new standard for compensation in motor accident cases, particularly for victims requiring lifelong medical aids and replacements, ensuring that justice is both comprehensive and compassionate.

Motor Accidents Claims - Just compensation for permanent disability including periodic replacement and maintenance of prosthetic limb must be adequately considered to ensure dignity and functional mobility for the claimant throughout his life.
