The petitioner, Jithin James, approached the court suspecting that efforts were underway to detain him under preventive detention laws. During the admission hearing, the judges perceived potential issues with the petitioner's mental health and referred him to a Clinical Psychologist from the Kerala State Legal Services Authority's Victim Rights Centre. The preliminary assessment identified symptoms of schizophrenia, a concern confirmed by the Public Prosecutor, who clarified that no detention proceedings were pending against James.
Despite the lack of legal grounds for detention, the court emphasized the necessity of addressing the petitioner's health. Justice Nambiar directed Jithin James to attend a follow-up hearing with his father, wherein the court successfully persuaded him to seek medical treatment. Advocate Parvathi Menon A., recognized for her pro bono contributions, facilitated James's referral to the Psychiatry Department at the Government Medical College Hospital, Ernakulam.
The hospital's report confirmed a diagnosis of schizophrenia, with observations of delusions and auditory hallucinations. The medical team initiated antipsychotic medication, emphasizing the importance of supervised treatment, regular follow-ups, and ongoing psychosocial support.
In closing the petition as infructuous, the court expressed satisfaction with the petitioner's progress and commitment to follow medical advice.
