Court Cautions Against Premature Judgments During Bail Proceedings


In a significant ruling, the Kerala High Court has ordered the expungement of remarks made by a Special Judge in a bail order that were deemed prejudicial to the ongoing investigation and prosecution. The decision was delivered by Justice A. Badharudeen in response to petitions filed by the State of Kerala against the observations made by the Enquiry Commissioner and Special Judge (Vigilance), Kollam.


The case, involving respondent Kandararu Rajeevaru @ Rajeev T, arose from Crime Nos. 3700/2025 and 3701/2025, investigated by the Crime Branch Police Station in Thiruvananthapuram. The petitioners argued that the Special Judge's remarks in paragraphs 79, 80, 87, and 88 of the bail order effectively provided a "clean chit" to the accused, which could adversely impact the investigation and subsequent trial.


The State's legal representatives, Special Public Prosecutor Sri. A. Rajesh and Sr. Public Prosecutor Smt. Rekha S., contended that while the court has the authority to assess allegations at the bail stage, such observations should not undermine the ongoing investigation or the eventual prosecution. They further asserted that the remarks could prejudice the case by influencing the trial court's perceptions.


Responding to these concerns, the High Court emphasized the principle that while courts can evaluate prima facie evidence during bail proceedings, they must refrain from making determinations that could preempt the investigation or trial outcomes. Justice Badharudeen noted that the trial court's role is to assess all prosecution materials comprehensively when considering discharge or framing charges, without being swayed by earlier observations made at the bail stage.


The respondent's counsel, referencing previous rulings from the Supreme Court, argued that the Special Judge's order was reasoned and in line with established legal principles. However, the High Court found that the remarks in question overstepped the boundaries of a bail hearing, potentially prejudicing the investigation.


In conclusion, the Kerala High Court ordered the expungement of the contentious remarks, underscoring that the trial court must base its decisions on evidence presented during the trial, independent of any prior judicial comments made during bail considerations.


Bottom line:-

Observations made by the Special Judge in granting bail should not prejudice the investigation or annul the prosecution. Courts must refrain from making remarks that efface the investigation or preempt the trial.
