Court Directs Nurses Association to Defer Strike, Facilitates Mediation for Uninterrupted Healthcare Services


In a significant intervention aimed at resolving the ongoing wage dispute between the Nurses Association and hospital managements in Kerala, the Kerala High Court has directed the parties to engage in mediation to settle the conflict amicably. The decision, passed by Justice Mohammed Nias C.P., comes amidst tensions over wage and service conditions that have affected 28 hospitals under the Kerala Private Hospital Association.


The High Court has underscored the importance of mediation by referring the involved parties to the Mediation Centre attached to the Court. The aim is to facilitate a negotiation that would ensure the smooth functioning of healthcare services, thus preventing any adverse impact on patients and the public seeking medical care.


Acknowledging the indispensable role of nurses in the healthcare system, the court observed that prolonged disputes could disrupt hospital operations and cause significant hardship to patients. Therefore, both parties have been urged to approach the mediation process responsibly, keeping in mind the broader public interest.


To create a conducive environment for effective mediation, the Nurses Association has been instructed to defer any planned strike actions until March 19, 2026. Simultaneously, the hospital managements are expected to participate in the mediation process in good faith, aiming for an equitable resolution. Both parties have been advised against any actions that could exacerbate the existing tensions.


The court has scheduled the initial mediation meeting for March 17, 2026, at the Kerala State Mediation and Conciliation Centre, High Court of Kerala. The court has also requested a mediation report to be submitted by March 19, 2026, which will be reviewed in a subsequent hearing.


This judicial intervention highlights the critical need to balance employee rights and public health interests, emphasizing the necessity for an amicable resolution to ensure uninterrupted healthcare services across the state.
