In a significant move, the Kerala High Court has come to the aid of a 92-year-old petitioner, Mr. C.J. Mathews, in his prolonged battle against municipal inaction regarding dangerous trees threatening his property. The court, presided by Justice P.V. Kunhikrishnan, has directed the municipal authorities to remove the perilous trees within a month, invoking Section 412 of the Kerala Municipalities Act, 1994.


Mr. Mathews, a retired Ministry of Defence official, has been entangled in a bureaucratic struggle for nine years, trying to address the threat posed by trees and snake-infested bushes on an adjacent property in Ernakulam. Despite multiple representations to local authorities and orders from the Revenue Divisional Officer and the District Collector, effective action was not taken, compelling Mathews to seek judicial intervention.


The court noted the grave oversight by municipal authorities who failed to act despite clear directives and evidence of danger. Justice Kunhikrishnan emphasized the role of constitutional courts in protecting citizens' rights when faced with bureaucratic inefficiency. Highlighting the anxiety faced by the elderly due to environmental threats, the judgment underscored the necessity for prompt and sensitive redressal of such grievances.
