In a significant ruling, the Kerala High Court has modified the bail conditions imposed on Hiran Das Murali, a professional singer facing charges under Sections 376 and 376(2)(n) of the Indian Penal Code. The decision, delivered by Justice Bechu Kurian Thomas, comes as a relief to the artist, who had been restricted from traveling abroad due to pending legal proceedings.


The court had initially imposed a condition preventing Murali from leaving India without permission from the jurisdictional court while granting him anticipatory bail. This restriction was set to ensure his availability during the investigation. However, with the investigation concluded and the final report filed, the court acknowledged that the condition had served its purpose.


Murali, represented by a team of legal advocates, argued that the travel restriction was detrimental to his career, as he had been invited to perform in various international concerts, including in Dubai, Qatar, France, and Germany. The defense emphasized that the inability to travel would significantly hinder his professional engagements.


Despite objections from the defacto complainant’s counsel, who expressed concerns about the possibility of Murali absconding, the court recognized the professional obligations of the accused. It held that the pendency of a criminal case should not prevent an individual from pursuing their profession or vocation.


In its order, the court decided to delete the original travel restriction condition and replace it with new requirements. Murali must now inform the Investigating Officer of his travel plans at least one week before leaving the country. This includes providing his itinerary, place of stay, an affidavit with his passport details, and a contact number for his time abroad. These measures aim to ensure Murali's availability during the committal proceedings and trial.


The court's decision underscores the balance between allowing an accused person to continue their livelihood while ensuring their presence for judicial processes. The ruling is expected to have implications for similar cases where professional commitments necessitate international travel.
