Kerala High Court Orders Comprehensive Safety Audit of Mental Health Centres

Following a distressing incident, the court mandates stringent security measures and accountability to protect patients and the public.

In a decisive move to bolster safety in mental health institutions, the Kerala High Court has directed an immediate and comprehensive safety audit of all Mental Health Centres across the state. This directive comes in response to a disturbing incident where a person in need of care escaped from the Mental Health Centre in Thrissur and subsequently inflicted grievous injuries on three individuals.

The court, presided over by Justices Mr. Devan Ramachandran and M.B. Snehalatha, expressed grave concerns over the current security protocols at these centres. The bench emphasized the urgency of the matter, highlighting the necessity to prevent such incidents in the future, which pose a significant risk to both patients and the general public.

The court has appointed Amici Curiae, Sri. V.Ramkumar Nambiar and Smt. Sathyashree Priya Easwaran, to assist in the audit process, ensuring thorough examination and rectification of security measures. The involvement of the Amici Curiae underscores the court’s commitment to an impartial and exhaustive review.

In its order, the court has impleaded several key authorities, including the Secretary of Health and Family Welfare Department, the Directorate of Health Services, and police officials, to ensure a coordinated and effective response to the incident. The court has mandated these authorities to submit detailed reports on the measures implemented to enhance safety and security at the centres.

Moreover, the court has instructed the Director of Health Services to collaborate with other officers for the audit, focusing on areas where vulnerable individuals are housed. The audit report is to be submitted by the next hearing date, scheduled for March 3, 2026.

In addition to the audit, the District Medical Officer in Thrissur has been directed to assess the condition of the injured individuals and report on their treatment and the financial provisions made for their care.

This proactive judicial intervention underscores the High Court’s commitment to safeguarding the rights and wellbeing of individuals in mental health care, while also ensuring public safety. The directions issued are expected to lead to significant improvements in the operational protocols of mental health facilities, thereby preventing future occurrences of such distressing incidents.
