Kerala High Court Orders Formation of Special Investigation Team for Unlawful Online Activities

Allegations of unlawful online advertisements for remuneration, egg donation, and surrogacy under investigation.


In a significant move to address allegations of unlawful activities, the Kerala High Court has directed the formation of a Special Investigation Team (SIT) to probe into claims involving online advertisements that offer remuneration and induce individuals for egg donation and surrogacy. The decision came in response to a petition filed by ART Bank against the State Police Chief of Kerala and others.


The division bench comprising Justices Devan Ramachandran and M.B. Snehalatha emphasized the necessity of a robust and comprehensive investigation to ensure that all aspects of the allegations are thoroughly examined. The Court underscored that the police and relevant authorities should not delay the investigation waiting for orders from the Judicial Magistrate of the First Class, except for specific matters already presented before it.


The Court's directive was issued after reviewing a report from the Station House Officer, Kalamassery Police Station, which highlighted the detection of various unlawful activities through preliminary investigations. These activities included online advertisements luring victims with promises of remuneration for egg donation and surrogacy services.


The Court's order comes in the wake of its previous orders dated 29th September 2025 and 17th October 2025, which laid the groundwork for the investigating officers. The bench expressed its view that the investigation should proceed without unnecessary delays and that a special team would be crucial in considering all facets of the case.


The learned Government Pleader was instructed to obtain specific directions from the State Police Chief regarding the formation of the SIT and to update the Court on the progress by the next scheduled hearing date on 10th December 2025.


This directive from the Kerala High Court highlights the judiciary's proactive stance in tackling emerging crimes in the digital space, ensuring that justice is not only served but is seen to be served through swift and decisive action.
