Court Directs Police Assistance to Ensure Execution of Long-Pending Decree Amidst Third-Party Obstructions


In a significant ruling, the Kerala High Court has directed police assistance to ensure the execution of a decree originally passed in 1984, which has been delayed due to obstructions by third parties. The judgment, delivered by Justice T.R. Ravi, underscores the court's commitment to ensuring that decree holders can reap the benefits of litigation, even amidst persistent obstructions.


The case, Subhadra and others versus Kalukurumban (Died), Ayyappan and others, concerns a decree passed by the Munsiff Court, Perumbavoor, declaring title and injunction in favor of the petitioners. Despite being affirmed by the Sub Court, Perumbavoor, the Kerala High Court, and the Supreme Court, the execution of the decree has been obstructed by third parties not originally involved in the suit.


The petitioners had sought to implead these third parties in the execution proceedings, but their application was rejected on the grounds that the suit was not instituted in a representative capacity, thus not satisfying the procedural requirements of Order 1, Rule 8 of the Civil Procedure Code, 1908.


Justice Ravi, acknowledging the correctness of the lower court's order, emphasized that technicalities should not allow an illegality to persist. The court directed the Munsiff Court to ensure police assistance for the execution of the decree, granting necessary protection to the Amin and the Advocate Commissioner.


The judgment highlights the court's supervisory jurisdiction under Article 227 of the Constitution of India, allowing it to direct necessary actions to ensure justice. The decision reflects the court's proactive stance in dealing with execution delays, especially when the decree has been upheld at all judicial levels.


The court further instructed that necessary actions be taken against obstructors, whether they are judgment debtors, claimants through them, or strangers, to prevent further delays. The trial court has been directed to issue orders expeditiously, ensuring that the decree is executed before the court's summer recess.


This ruling reinforces the judiciary's role in enforcing legal rights and ensuring that judicial decrees do not become futile due to procedural hurdles and external obstructions.
