In a significant ruling, the Kerala High Court has set aside the Kerala State Minority Commission's decision to evict Moideenkutty from his residential property, emphasizing the Commission's lack of jurisdiction in matters that traditionally fall under the purview of civil courts. The judgment was delivered by Justice Easwaran S. in response to a writ petition filed by Moideenkutty against the Kerala State Minority Commission and other respondents.


The case revolved around two sale deeds executed by Moideenkutty in favor of the second respondent, who subsequently sought the Minority Commission's intervention to evict the petitioner from the property. Despite the Commission's mandate under the Kerala State Commission for Minorities Act, 2014, which limits its role to evaluating and recommending measures for the welfare of minorities, it proceeded to order the eviction, leading to legal proceedings.


Justice Easwaran S. clarified that the Kerala State Minority Commission does not possess the authority to entertain complaints seeking eviction or to issue binding orders of eviction. The judgment underscored that issues involving property disputes should be resolved in competent civil courts, and any attempt by quasi-judicial bodies to bypass this process is beyond their jurisdiction and void.


The High Court's decision reasserted the limitations on the Commission's powers, particularly under Sections 9 and 11 of the Kerala State Commission for Minorities Act, 2014. These sections outline the Commission's functions, focusing on making recommendations rather than taking coercive actions like eviction. The judgment also highlighted the importance of adhering to statutory mandates to prevent overstepping jurisdictional boundaries.


As a result of the judgment, the writ petition was allowed, and the orders issued by the Minority Commission were quashed. Moideenkutty is to be reinstated in his property within two days, with the second respondent advised to pursue legal remedies through civil courts for any grievances related to the property.


The ruling serves as a reminder of the importance of jurisdictional adherence by statutory bodies, ensuring that the powers conferred upon them are exercised within their defined scope.
