Kerala High Court Quashes Ombudsman Proceedings Against Village Officer

Court clarifies Village Officers are not "public servants" under Kerala Panchayat Raj Act for Ombudsman jurisdiction.


In a significant judgment, the Kerala High Court has ruled that Village Officers do not qualify as "public servants" under the Kerala Panchayat Raj Act, 1994, thereby quashing proceedings against a Village Officer initiated by the Ombudsman for Local Self Government Institutions. The ruling was delivered by Justice P.V. Kunhikrishnan in response to a writ petition filed by Saheer, a Village Officer from Pathiyoor Village, who challenged the maintainability of the complaint lodged against him.


The petitioner contended that the provisions of the Kerala Panchayat Raj Act, specifically Section 271F(g), do not categorize Village Officers as public servants. This section delineates public servants as employees or officers under Local Self Government Institutions or elected members, including Presidents or Chairpersons. Justice Kunhikrishnan, agreeing with the petitioner's argument, held that the petitioner did not fall within these categories, thus proceedings against him could not be sustained.


The court emphasized that the definition of "public servant" and "complaint" as per Sections 271F(g) and 271F(c), respectively, and the functions of the Ombudsman under Section 271J, do not encompass Village Officers. Consequently, complaints against them are not maintainable before the Ombudsman.


However, the court clarified that the Ombudsman could proceed against other respondents in the complaint if allegations against them were found to be substantiated. The proceedings against respondents other than the Village Officer were not affected by this judgment and could continue in accordance with the law.


The judgment reiterates the jurisdictional boundaries of the Ombudsman under the Kerala Panchayat Raj Act, thereby providing clarity on the scope of individuals and officers it can take action against. This decision is expected to have significant implications for how complaints involving local self-government employees are handled.


Bottom Line:

A Village Officer does not qualify as a "public servant" under Section 271F(g) of the Kerala Panchayat Raj Act, 1994, and hence, proceedings against such an officer cannot stand before the Ombudsman for Local Self Government Institutions.
