Kerala High Court Recalculates Compensation in Motor Accident Claim

Major siblings residing separately not entitled to dependency compensation; award recalibrated following Supreme Court guidelines.


In a recent judgment, the Kerala High Court delivered a significant verdict in the case of New India Assurance Company Limited v. Devaki, addressing the issue of compensation claims under the Motor Vehicles Act, 1988. The case, presided over by Justice Shoba Annamma Eapen, revolved around the compensation claims filed by the siblings of a deceased individual, Ms. Santhamma, who tragically lost her life in a road traffic accident.


The primary contention in the appeal was the quantum of compensation awarded by the Motor Accidents Claims Tribunal, Mavelikara, particularly under the head of loss of dependency. The tribunal had previously awarded Rs. 6,89,400/- to the claimants, with the insurer, New India Assurance Company, challenging the notional income fixed and the entitlement of major siblings to dependency compensation.


Justice Eapen clarified that only the second claimant, who was a spinster residing with the deceased, qualified as a dependent based on presented evidence. The other siblings, being majors living separately with their families, were not deemed dependents in the absence of specific evidence proving dependency. This distinction resulted in a recalibration of compensation, reducing the award from Rs. 5,54,400/- to Rs. 3,73,329/- under the loss of dependency head.


Additionally, the court addressed discrepancies in the tribunal's calculation of notional income and deductions for personal expenses. The tribunal's previous fixation of the deceased's income at Rs. 7,000/- was corrected to Rs. 6,285/- based on the deceased’s pension passbook. Further, the court applied a 10% addition for future prospects, aligning with the Supreme Court's judgment in Pranay Sethi, and adjusted deductions for living expenses to one-half, consistent with established legal standards for unmarried individuals.


Moreover, the court annulled the tribunal's directive of imposing a 12% penal interest on the insurer, citing its unsustainability in light of Supreme Court jurisprudence.


The judgment underscores the judiciary's commitment to upholding equitable compensation practices in motor accident claims, ensuring that awards are both fair and reflective of legal precedents.
