Kerala High Court Upholds Conviction of Forest Officer in Bribery Case

Muheshkumar K's appeal against the conviction under the Prevention of Corruption Act dismissed; one-year rigorous imprisonment confirmed.


In a significant ruling, the Kerala High Court has upheld the conviction and sentencing of Muheshkumar K, a Forest Officer, under the Prevention of Corruption Act, 1988. The judgment, delivered by Justice A. Badharudeen, dismissed the appeal filed by Muheshkumar, thereby confirming the one-year rigorous imprisonment along with a fine of Rs. 25,000 for his involvement in demanding and accepting bribes.


The court found the evidence presented by the prosecution to be credible and reliable, especially the testimony of the complainant, despite his criminal antecedents. The case against Muheshkumar involved multiple instances of bribe demand and acceptance, corroborated by trap proceedings conducted by the Vigilance and Anti-Corruption Bureau (VACB). The court rejected the defense argument that the money was a donation for a temple festival, citing a lack of credible proof.


The conviction was based on sections 7 and 13(1)(d) read with section 13(2) of the Prevention of Corruption Act, which require proof of demand and acceptance of illegal gratification. The court emphasized that mere acceptance of money does not constitute an offense unless there is a proven demand for illegal gratification.


Justice Badharudeen reaffirmed the importance of credible evidence, noting that the presumption of guilt under section 20 of the Act is applicable once the foundational facts are established. The judgment also highlighted that the testimony of a witness with criminal antecedents cannot be dismissed outright if it meets the criteria of consistency, corroboration, and reliability.


The appeal's dismissal means that Muheshkumar must now surrender to the Special Court to serve his sentence, with the court directing immediate execution of the sentence if he fails to comply.
