Court Ruling Allows Indian Army to Proceed with Security Infrastructure Without Prior Tree Cutting Permission


In a significant ruling, the Madhya Pradesh High Court has clarified that certain categories of land, specifically those related to security and defense infrastructure, are exempt from previous orders that restricted tree cutting in Madhya Pradesh. The clarification follows the enactment of the Forest (Conservation) Amendment Act, 2023, which introduced Section 1A into the principal Forest (Conservation) Act, 1980.


The judgment was delivered by a bench comprising Chief Justice Sanjeev Sachdeva and Justice Vinay Saraf, in response to an application filed by the Indian Army. The Army contended that the court's earlier order dated November 26, 2025, which mandated that no trees be cut, pruned, or transplanted without prior permission, was obstructing the construction of security-related infrastructure.


The Deputy Solicitor General representing the Indian Army highlighted the exemptions provided under Section 1A of the amended Act. These exemptions include lands proposed for security-related and defense projects, such as strategic constructions along international borders and infrastructure for national security purposes. The court examined the sealed details of the proposed projects and subsequently clarified that its previous order would not apply to the specified exempted lands under the amendment.


The court's decision underscores the balance between environmental conservation and national security needs, permitting the Army to proceed with critical infrastructure projects without the procedural hindrance of obtaining prior tree-cutting permissions.


This ruling holds particular significance for projects situated within a hundred kilometers of international borders or areas affected by Left Wing Extremism, where the need for swift and strategic infrastructure development is paramount.


The matter has been scheduled for further consideration on June 30, 2026, and interim relief, as modified, is to continue until further orders.
