Madhya Pradesh High Court Dismisses Abhishek Banerjee’s Petition for Non-Prosecution

Court Lifts Stay on Arrest Warrant as Petitioner Fails to Appear

In a notable decision on June 17, 2026, the Madhya Pradesh High Court at Jabalpur dismissed a criminal petition filed by Abhishek Banerjee against Akash Vijayvargia. The dismissal was due to non-prosecution, as the petitioner failed to appear in court during both the initial and subsequent rounds.

The case, Misc. Criminal Case No. 51319 of 2025, was presided over by Justice Pramod Kumar Agrawal. The court noted the absence of representation on behalf of the petitioner during the scheduled hearings, leading to the conclusion that the petitioner had lost interest in pursuing the matter further.

This petition had previously resulted in a stay order dated November 12, 2025, which halted the execution of an arrest warrant issued in Case No. SC PPM/2/2024 by the Judicial Magistrate First Class (J.M.F.C.) and Special Judge for MP/MLA cases in Bhopal. However, with the dismissal of the petition, the stay was vacated, reinstating the warrant's execution.

Justice Agrawal directed the court registry to immediately communicate the order to the concerned Trial Court, ensuring prompt procedural follow-up.

The case underscores the importance of active prosecution by petitioners in legal proceedings, as failure to do so can result in unfavorable outcomes, such as the lifting of previously granted stays on legal actions.

Bottom Line:

Petition dismissed for want of prosecution due to non-appearance of the petitioner. Stay on execution of arrest warrant vacated.

Statutory provision(s): Criminal Procedure Code, 1973.
