High Court Warns Against Misuse of Public Interest Litigation for Personal Vendettas


In a significant ruling, the Madhya Pradesh High Court at Indore dismissed a Public Interest Litigation (PIL) filed by Sachin Sisodiya, imposing exemplary costs of Rs. 1,00,000 on the petitioner. The court found the PIL to be non-genuine, filed with ulterior motives aimed at blackmailing a private respondent, and thus an abuse of judicial process.


The bench, comprising Justices Vijay Kumar Shukla and Binod Kumar Dwivedi, observed that the petition was not filed in the true spirit of a PIL, which is meant to address genuine public interest issues. Instead, the court determined that the PIL targeted an individual, Rahul Chouhan, with whom the petitioner had a personal vendetta. This misuse of the PIL mechanism prompted the court to impose a monetary penalty on the petitioner to deter similar future conduct.


The court highlighted previous instances where the petitioner and associated parties had filed multiple petitions against the same individual, which were either dismissed or withdrawn. The High Court emphasized the importance of maintaining the sanctity of the PIL process and referenced Supreme Court guidelines on the matter. Notably, they cited the cases of "State of Uttaranchal v. Balwant Singh Chaufal" and "Gurpal Singh v. State of Punjab," which underscore the need for courts to discourage PILs filed with mala fide intentions.


In addressing the misuse of PILs, the court reiterated the need for the judiciary to ensure that such litigations are aimed at addressing genuine public harm rather than serving as tools for personal grievances. The court mandated that the costs imposed be directed towards upgrading the High Court Dispensary at Indore, thereby contributing to a public good.


This ruling serves as a stark reminder of the judiciary's stance against the exploitation of legal processes for personal vendettas, underscoring the importance of integrity in the filing of PILs. The court's decision aims to preserve the PIL mechanism as a tool for public welfare rather than allowing it to be hijacked for individual battles.
