Madhya Pradesh High Court Initiates Suo Motu PIL Over Rash Driving Incident

Court Seeks Accountability and Preventive Measures Following Fatal Truck Accident in Indore
In a significant move, the Madhya Pradesh High Court has initiated a Suo Motu Public Interest Litigation (PIL) following a tragic incident involving a heavy goods vehicle in Indore. The incident, widely reported by Dainik Bhaskar, saw a truck driven rashly through a busy residential area during peak evening hours, resulting in multiple casualties and significant property damage.
The bench, comprising Chief Justice Sanjeev Sachdeva and Justice Vinay Saraf, took cognizance of the alarming news report and video evidence showcasing the reckless driving. The incident reportedly led to 35 individuals sustaining injuries, with 12 suffering grievous harm, and tragically claimed three lives. The truck, having collided with several vehicles and pedestrians, eventually caught fire, further intensifying the chaos.
In response to the disturbing events, the court directed the Registry to register a Suo Motu PIL to address the concerns raised by the incident. Notices have been issued to the State Government through the office of the Advocate General, with Deputy Advocate General Mr. Swapnil Ganguly accepting the notice on behalf of the State.
The court has also impleaded the Commissioner of Police, Indore, as a respondent in the case. The Commissioner is tasked with filing an affidavit detailing the circumstances that allowed the truck to enter a busy residential area during peak hours, travel approximately 2 kilometers, and the reasons for the absence of immediate preventive action. This affidavit must also outline proposed measures to prevent such incidents in the future.
The matter is scheduled for further hearing on September 23, 2025, with the Commissioner of Police required to be present via video conferencing. Additionally, a senior officer is mandated to attend the hearing in person to ensure accountability and compliance with the court's directives.
The court's proactive approach in addressing this grave issue underscores the judiciary's commitment to public safety and accountability. This Suo Motu PIL serves as a crucial mechanism to prompt authorities to take necessary actions to prevent the recurrence of such tragic events, ensuring the safety and security of residents in Indore and beyond.
The Madhya Pradesh High Court's intervention highlights the importance of diligent enforcement of traffic regulations and the need for robust preventive strategies to protect citizens from the dangers posed by negligent driving. As the state awaits the implementation of corrective measures, this case stands as a testament to the judiciary's role in safeguarding public interest and promoting justice.
