Madhya Pradesh High Court Mandates Digital Access to Archeological Survey Videography

High Court Orders ASI to Upload Bhojshala Survey Videos Online for Fair Objection Process

In a significant directive, the Madhya Pradesh High Court has ordered the Archeological Survey of India (ASI) to upload the videography of the survey conducted at the Bhojshala site on a secured digital platform. This order aims to ensure transparency and adherence to the principles of natural justice by allowing involved parties to access the video content for objections. The bench, comprising Justices Vijay Kumar Shukla and Alok Awasthi, emphasized the importance of making the videography accessible to the counsel for respondent No.8, Maulana Kamaluddin Welfare Society, and the High Court itself.

The directive follows a previous order from the Supreme Court, which highlighted the necessity for the High Court to consider objections arising from the videography in accordance with natural justice principles. The High Court has set a deadline for the ASI to complete the upload by April 27, 2026, underscoring the priority of this task given the ongoing day-to-day hearings.

The ASI had initially expressed concerns about the extensive nature of the 96-day videography and the time required for its display or distribution. However, the High Court insisted on compliance with the Supreme Court's earlier observations, dismissing the ASI's apprehensions regarding the scope of video access.

The court's order extends beyond just uploading the videography, as it mandates that a copy of the order be promptly communicated to the Director General and Superintendent of the ASI to ensure swift action.

The case, which involves multiple petitions and appeals, continues to be a focal point for legal scrutiny and is scheduled to resume on April 22, 2026.

Bottom Line:

Archeological Survey - Videography of survey proceedings directed to be uploaded on a secured digital platform to ensure access for parties involved and to facilitate objections in compliance with principles of natural justice.

Statutory provision(s): Principles of Natural Justice, Compliance and Communication Directives.
