Madhya Pradesh High Court Orders Formation of Committee to Combat Illegal Encroachment on Gwalior Hillocks

Court Mandates Environmental Protection Measures and Public Participation for Sustainable Development

The Madhya Pradesh High Court has issued a significant directive aimed at curbing the illegal encroachment and excavation activities threatening the hillocks surrounding Gwalior city. In a landmark judgment delivered on April 2, 2026, in the case of Jandel Singh Yadav v. State of Madhya Pradesh, the court has ordered the establishment of a specialized committee under the chairmanship of the District Collector, Gwalior. This committee is tasked with safeguarding these hillocks and promoting biodiversity through extensive plantation drives.

The judgment comes as a response to a Public Interest Litigation (PIL) filed by Jandel Singh Yadav, highlighting the rampant encroachment and excavation by land mafias, which pose a severe threat to the environment. The court recognized the urgency of the matter, emphasizing the existential nature of the issue and the necessity for decisive action.

The committee will comprise various stakeholders, including subject experts, administrative officers, and eminent persons from the community. Its mandate includes conducting surveys of hillocks, ensuring their protection through fencing, and undertaking plantation drives with ayurvedic, medicinal, and fruit-bearing trees. The court stressed the importance of public participation, urging citizens to proactively engage in the project's implementation.

Furthermore, the judgment elaborates on the concept of "Social Audit" under the Madhya Pradesh Municipal Corporation Act, 1956, recognizing the city residents as vital stakeholders in urban governance and environmental management. The court underscored the role of social audits in ensuring effective urban planning and sustainable development.

The committee is expected to meet fortnightly to conceptualize the project, evaluate performance, and plan future actions. The court also encouraged professional organizations and public representatives to assist in resource mobilization and execution.

Inspired by earlier initiatives like the "Ek Ped Maa Ke Naam" campaign, the court highlighted the importance of water harvesting and digital documentation of plantation efforts for future carbon credit records. It called upon the committee to explore technological solutions such as mobile apps for comprehensive documentation.

The judgment is seen as a pivotal step towards environmental conservation and sustainable development in Gwalior, with potential implications for similar initiatives across the state. The court’s directive serves as a call to action for authorities and residents to collaborate in preserving the natural landscape and enhancing the city's green cover.

Bottom line:-

Public Interest Litigation - Protection of government land/hillocks from illegal encroachment and excavation - Constitution of a specialized committee for safeguarding hillocks and ensuring biodiversity through plantation drives.
