Court Orders Retrospective Promotion for Officer Who Bravely Saved Lives by Descending a 200-foot Gorge


In a landmark judgment, the Madhya Pradesh High Court has quashed an order denying an out-of-turn promotion to Sub-Inspector Indramani Patel, who demonstrated exceptional bravery by descending a 200-foot gorge to rescue individuals from a precariously positioned truck. The court found the decision by the screening committee to deny the promotion as arbitrary and perverse, given the unanimous recommendations from senior police officers. Justice Vivek Kumar Singh ordered the state to promote Patel to the rank of Inspector retrospectively from 2005, with all consequential benefits except back wages, to be implemented within 60 days.


The incident took place on the night of April 22, 2004, when Patel, acting as Station House Officer at Police Station Simrol, responded to an emergency involving a truck hanging over a gorge near Indore. Despite the refusal of professional crane operators to assist, Patel bravely descended into the gorge using a rope, successfully rescuing the driver and helper, and securing the truck to prevent further danger.


The court criticized the screening committee's mechanical rejection of Patel's promotion, terming it a routine duty, which starkly contrasted with the recognition of his bravery through a cash reward. The judgment emphasized that such acts of bravery are precisely what Regulation 70-A of the Madhya Pradesh Police Regulations aims to reward, and the committee's failure to apply the correct parameters constituted a glaring injustice.


This decision sets a significant precedent in ensuring that extraordinary acts of bravery by law enforcement officers are recognized and rewarded appropriately, aligning with the principles of fairness and reasonableness.
