Conviction under Section 406 IPC Set Aside; Section 420 IPC Maintained for Deceiving Job Aspirants


In a significant judgment, the Madhya Pradesh High Court at Indore has upheld the conviction of Rameshchandra, who was found guilty of cheating several students by impersonating a former official and promising them employment in public offices. The court maintained the conviction under Section 420 of the Indian Penal Code (IPC) for cheating but set aside the conviction under Section 406 for criminal breach of trust.


The case, which involved fraudulent activities during the Combined Recruitment Test - 2022, saw Rameshchandra deceiving aspirants by assuring them job placements in exchange for Rs. 2,00,000 each. Despite his denial of the charges and claims of false implication, the prosecution successfully demonstrated that he received a total of Rs. 12,00,000 from multiple victims.


Justice Gajendra Singh, presiding over the criminal revision, noted the gravity of the offence and emphasized the need for stringent punishment to deter similar crimes. The court referenced previous judgments, including Delhi Race Club (1940) v. State of UP and Arshad Neyaz Khan v. State of Jharkhand, to support its decision that criminal breach of trust and cheating cannot co-exist, leading to the setting aside of the Section 406 conviction.


The High Court affirmed the sentence imposed under Section 420 IPC, highlighting the seriousness of cheating students with false promises of employment. The revision petition was partially allowed, with Rameshchandra acquitted of charges under Section 406 IPC but his conviction and sentence under Section 420 IPC upheld.


This judgment serves as a stern reminder of the legal consequences awaiting individuals who engage in fraudulent practices, especially those exploiting vulnerable job seekers.
